TERMS OF SERVICE
Terms of Service

These Terms govern your use of the Octopus DevOps platform (the "Service"), operated by Octopus DevOps S.A.S. By creating an account or using the Service, you agree to these Terms in full.
1. Acceptance of these Terms
By accessing octopusdevops.com, registering, or using the Octopus DevOps console, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Service.
2. Who We Are
The Service is operated by Octopus DevOps S.A.S., Tax ID (NIT) 901.873.899-8, registered at Calle 3 # 22 - 01, Chía, Cundinamarca, Colombia. You can reach us at contacto@octopusdevops.com or +57 300 992 0223.
3. Description of the Service
Octopus DevOps is a platform that automates the generation and execution of CI/CD pipelines, orchestrates deployments to the Customer's own cloud (GCP, AWS, Azure), and provides integrated security analysis (SAST, SCA, secrets detection, and infrastructure-as-code scanning) through the Octopus Security Platform (OSP) engine. The Service always acts under the Customer's instruction and on the Customer's own connected infrastructure.
4. User Accounts
You must be at least 18 years old and have the legal capacity to enter into agreements on your own behalf or on behalf of your organization. You are responsible for keeping your credentials confidential and for all activity that occurs under your account.
You may sign in with a username and password, or via single sign-on (SSO) with Google, Microsoft, or GitHub where available for your organization.
5. Plans, Pricing and Billing
Available plans (Community, Foundation, Scalability, and Enterprise) and their prices are published at octopusdevops.com/plans and may be updated from time to time; price changes do not retroactively affect an already-billed period.
All payment transactions are processed through Paddle.com Market Limited ("Paddle"), acting as Octopus DevOps' authorized reseller and Merchant of Record. The charge on your statement may appear under Paddle's name. Paddle is responsible for processing payment, applying any taxes applicable to your location, and issuing the invoice.
6. Cancellation and Termination
You may cancel your subscription at any time from the platform's billing panel. Upon cancellation, you keep full access until the end of the period already paid for — see our Refund Policy for details.
Octopus may suspend or terminate your account for breach of these Terms, misuse of the Service, or failure to pay after a plan's expiration.
If a plan expires and is not renewed, the organization has a 60-day grace period before its data (projects, deployment history, users, and secrets) is permanently deleted, in accordance with our Privacy Policy.
7. Acceptable Use
When using the Service, you agree not to:
- Use the platform to scan, deploy to, or otherwise act on third-party systems or infrastructure without the owner's express authorization.
- Reverse-engineer, decompile, or attempt to extract the platform's source code.
- Deliberately overload the Service's infrastructure or interfere with its normal operation.
- Use the Service for illegal activity, malware distribution, or to infringe third-party intellectual property rights.
- Share your access credentials with unauthorized persons, or resell the Service without Octopus' written authorization.
8. Intellectual Property
Octopus DevOps retains all rights to the platform, its software, brand, and documentation. You retain all rights to your own source code, project configuration, and any data you upload or generate using the platform. We do not claim ownership of your organization's code or data.
9. Customer Data and Confidentiality
Processing of personal data is governed by our Privacy Policy. Both parties agree to keep confidential any non-public technical and business information shared in the course of the relationship.
10. Third-Party Integrations
The Service relies on external providers, including Jenkins, Google Cloud Platform, OpenAI, and Paddle. Octopus is not responsible for Service interruptions or failures caused by these providers' unavailability, beyond our reasonable control.
11. Service Availability
Octopus strives for continuous platform availability but does not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available," without warranties of any kind, express or implied.
12. Limitation of Liability
To the maximum extent permitted by Colombian law, Octopus will not be liable for indirect, incidental, special, or consequential damages arising from use of the Service. Octopus' total aggregate liability to a Customer will not exceed the amount actually paid by that Customer in the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Octopus DevOps S.A.S. against third-party claims arising from your misuse of the Service or your breach of these Terms.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified at least 15 days in advance by email or via a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of those changes.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Any dispute arising from these Terms will be submitted to the competent courts of Chía, Cundinamarca, Colombia, without prejudice to any alternative dispute resolution mechanism the parties expressly agree to.
